Role of police in juvenile justice system: Policy and practice

Abstract: A lot of jurisprudential ink has flown in the attempt to afford the necessity for the protection of the children and maintaining the best interest of them and the society, at large. Undoubtedly, the children require special treatment and care as they are the future of our Nation. Police is the first agency to bring the children under purview of the children Acts. The behavior of the police personnel and the environment in the police station for howsoever a brief period, are the first encounters of these children with the State machinery and these determine to a large extent the attitude of the children towards the juvenile justice system.The author, in this paper, attempts to elucidate on this issue highlighting the various provisions in the Juvenile Justice Act in relation to role of police in handling child offenders, analyzing the flaws in the law and the gross violation in its implementation. She highlights the necessity of juveniles being treated properly by the enforcement agencies including the police officials. She also attempts to make a comparative analyses of policing in America and India with special reference to juvenile handling. She submits certain necessary suggestions that may seen indispensable in the contemporary scenario.
