An interrogation of the legal and institutional frameworks for other sexual crimes in Nigeria

Abstract: This is a well-structured abstract for a research paper on criminal liabilities for sexual crimes in Nigeria, excluding rape. The paper highlights the focus on rape in legal discourse, while other sexual crimes receive less attention, despite being statutorily provided for under various Nigerian legislation. The paper aims to: appraise legal frameworks for sexual crimes other than rape, examine specific sexual crimes and their elements under the law and discuss challenges and limitations to apprehension and prosecution. The paper adopts a traditional doctrinal approach, using primary sources (legislation, case laws) and secondary sources (textbooks, articles, online materials). The paper adopts the traditional doctrinal research methodology, including the use of primary and secondary sources of law. The primary source will make use of relevant legislation such as the Criminal Code Act, Penal Code Act, Child Rights Act, Violence Against Persons Act, Sexual Harassment in Institution Prohibition Bill 2020, and case laws by the Supreme Court and Court of Appeal of Nigeria as well as those of persuasive opinions of foreign jurisdictional courts. The secondary sources will harness case digests, case reviews, case summaries, published textbooks, journal articles, and online materials written by scholars in the field of criminal law. Through these sources, the essay has carried out contextual and desktop paper and analysis of the data obtained.In conclusion, the paper identified certain problems with the investigation and prosecution of other sexual crimes will be discovered and the paper will proffer necessary recommendations for possible changes and reforms.
